DEFINITIONS
"Services" refers to all web-based online training, educational content, streaming videos, downloadable assets, footage, and related materials provided by VFXcited.
"Training Content" includes all instructional videos, tutorials, documentation, and educational materials provided through the platform.
"Individual Account" means a personal user account registered to a single individual for their exclusive use.
"You" or "User" refers to the individual or entity accessing or using VFXcited services.
GOVERNING LAW AND JURISDICTION
This Agreement and all related matters shall be governed by and construed in accordance with the laws of the Province of Québec, Canada, without regard to its conflict of law provisions. You acknowledge and agree that you submit to the non-exclusive jurisdiction of the courts of Québec, Canada, and any court hearing appeals from those courts, for the resolution of any disputes arising from or relating to this Agreement or your use of the Services.
ACCOUNT REGISTRATION AND ACCESS
To access our web-based training services, you must create an Individual Account. You are responsible for:
• Providing accurate, current, and complete information during registration
• Maintaining the security and confidentiality of your account credentials
• All activities that occur under your account
• Notifying VFXcited immediately of any unauthorized use of your account
VFXcited reserves the right to refuse registration or terminate accounts at our sole discretion for any reason, including but not limited to violation of these Terms and Conditions.
AGE REQUIREMENTS
Users must be at least 13 years of age to create an account and use the Services. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Services with the involvement, supervision, and consent of a parent or legal guardian who agrees to be bound by these Terms.
By allowing a minor to use the Services, the parent or legal guardian accepts full responsibility for the minor's use of the Services, including all financial charges and legal liability that may result from such use.
PRICING AND PAYMENT
Certain courses and services require a one-time payment, which is charged in advance. All prices are displayed on our website and may vary by currency based on your geographic location to reflect regional economic standards.
Geographic Pricing Policy: Intentionally changing your location using Virtual Private Networks (VPNs) or similar technologies to circumvent regional pricing is strictly prohibited. Accounts found violating this policy may be terminated immediately without refund.
Payment Processing: All payments are processed securely through our third-party payment processors. By making a purchase, you agree to provide accurate payment information and authorize the charge.
ACCEPTABLE USE AND ACCOUNT SHARING
Individual Accounts: An Individual Account may only be used by a single user. Sharing login credentials, passwords, or account access with any other person is strictly prohibited. Upon discovery of account sharing between multiple individuals, accounts will be terminated immediately without refund.
Multi-User Access: Companies, educational institutions, and organizations wishing to provide training to multiple users must purchase appropriate multi-user plans at discounted rates. Please contact VFXcited through our contact page for information about these options.
Prohibited Activities: You agree not to:
• Use the Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the Services
• Interfere with or disrupt the Services or servers
• Use automated systems or software to extract data from the Services
• Post, upload, or transmit offensive, abusive, discriminatory, or unlawful content
• Reverse engineer, decompile, or disassemble any portion of the Services
CONTENT USAGE AND DOWNLOADS
Download Limits: VFXcited may limit the number of downloads available to Individual Accounts per day to maintain optimal service quality for all users. Downloads are provided solely to allow Individual Account holders to access assets and footage for their personal use in conjunction with the Training Content.
Streaming Content: Training Content delivered via streaming video is not available for download. Any attempt to record, capture, or reproduce streaming content is prohibited.
Content Sharing Prohibition: Sharing, distributing, or making Training Content or any materials available to others in any form (including but not limited to uploading to file-sharing services, social media, or peer-to-peer networks) is strictly prohibited. Upon discovery of content sharing, accounts will be terminated immediately without refund, and legal action may be pursued.
PRIVACY AND DATA PROTECTION
VFXcited is committed to protecting your privacy and handling your personal information responsibly in accordance with applicable privacy laws, including Québec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25).
Information We Collect:
• Account Information: Name, email address, and account credentials
• Payment Information: Billing details processed securely through third-party payment processors; VFXcited does not store complete credit card information
• Usage Data: Information about courses accessed and your progress for the purpose of providing the Services
• Technical Data: IP address and basic device information necessary for security and service delivery
• Communications: Messages you send to us
How We Use Your Information:
• To provide, maintain, and improve the Services
• To process transactions and send purchase confirmations
• To communicate with you about your account and respond to your inquiries
• To detect, prevent, and address technical issues and security threats
• To comply with legal obligations
No personal Analytics or Advertising: VFXcited does not use third-party personal analytics services (such as Google Analytics) or serve advertisements. We do not track your behavior across other websites or sell your personal information to third parties.
Essential Cookies Only: We use only essential cookies necessary for the operation of the Services, such as session cookies to keep you logged in. These cookies do not track your activity and are required for the Services to function properly.
Data Storage and Security:
Your personal information is stored on secure servers and protected using industry-standard security measures, including encryption, firewalls, and secure access controls. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
Your Rights:
Under applicable privacy laws, you have the right to:
• Access your personal information
• Request correction of inaccurate information
• Request deletion of your personal information (subject to legal retention requirements)
• Object to or restrict certain processing of your information
• Request data portability
To exercise these rights, please contact us using the information in Section 19.
Data Retention:
We retain your personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, it will be securely deleted or anonymized.
International Data Transfers:
Your information may be transferred to and processed in countries other than your country of residence for the purpose of providing the Services. We take appropriate measures to ensure that your data remains protected in accordance with this Agreement and applicable laws.
INTELLECTUAL PROPERTY AND COPYRIGHT
Ownership: All content provided through the Services, including but not limited to text, graphics, logos, images, audio, video clips, software, and all course-related materials, is the exclusive property of VFXcited and is protected by copyright laws, trademark laws, and other intellectual property rights.
Limited License: Subject to your compliance with these Terms, VFXcited grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Training Content solely for your personal, non-commercial educational purposes.
Restrictions: You may not:
• Copy, reproduce, distribute, or create derivative works from any content without prior written consent from VFXcited
• Sell, rent, lease, sublicense, or transfer any content to third parties
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use any content for commercial purposes without explicit written permission
User-Generated Content: If the Services allow you to submit, upload, or post content (such as comments, forum posts, or project files), you retain ownership of your content. However, by submitting content, you grant VFXcited a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content solely for the purpose of operating and improving the Services. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe upon any third-party rights.
REFUND AND CANCELLATION POLICY
General Policy: Due to the nature of digital products, the availability of substantial free content before purchase, one-time payment structure, and low pricing, refunds are not provided except under the specific circumstances outlined below.
Technical Failure: Refunds will be granted if VFXcited fails to deliver the purchased Training Content or footage due to internal technical difficulties that persist for more than 14 consecutive days, provided you have notified us of the issue within 7 days of discovering the problem.
Refund Process: To request a refund under the circumstances above, contact us using the information in Section 19 with your account details, purchase information, and a detailed description of the technical issue. Approved refunds will be processed within 14 business days to the original payment method.
No Refunds For: Refunds will not be provided for:
• Accounts terminated due to violations of these Terms and Conditions, including but not limited to account sharing, content distribution, or VPN abuse
• Change of mind after accessing the purchased content
• Dissatisfaction with content quality or difficulty level
• Technical issues on the user's end (incompatible device, internet connectivity, etc.)
SERVICE MODIFICATIONS AND AVAILABILITY
Right to Modify: VFXcited reserves the right to modify, update, enhance, discontinue, or limit any aspect of the Services, including training content, features, promotions, and course offerings, at any time and at our sole discretion. We may also update, revise, or add to the content of training programs without prior notice.
Service Availability: While we strive to provide continuous access to the Services, we do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any interruptions or downtime.
Uptime Commitment: We aim to maintain 99% uptime for our Services, excluding scheduled maintenance periods. Scheduled maintenance will be announced in advance when possible.
Right to Refuse Service: VFXcited reserves the right to refuse service, terminate accounts, or cancel access to any participant for any reason, including but not limited to violation of these Terms, suspicious activity, or behavior deemed harmful to VFXcited or other users.
WARRANTIES AND DISCLAIMERS
"AS IS" BASIS: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
DISCLAIMER OF WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VFXCITED EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• WARRANTIES THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING COMPLIANCE WITH LAWS OR GOVERNMENT REGULATIONS APPLICABLE TO YOUR USE
Content Delivery: VFXcited will make reasonable efforts to deliver the Training Content and materials you have purchased, subject to the limitations and conditions set forth in this Agreement.
User Responsibility: By using any materials provided through the Services, you accept all responsibility and liability for your actions and the results obtained from using such materials. You acknowledge that VFXcited is not responsible for any outcomes, results, or consequences arising from your use of the Training Content.
LIMITATION OF LIABILITY AND INDEMNIFICATION
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VFXCITED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOST PROFITS, LOST DATA, LOST CONTENT, OR BUSINESS INTERRUPTION
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA
• DAMAGES ARISING FROM ERRORS, OMISSIONS, OR INACCURACIES IN THE CONTENT
THE FOREGOING LIMITATIONS APPLY EVEN IF VFXCITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
MAXIMUM LIABILITY: THE MAXIMUM LIABILITY OF VFXCITED TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE FORM OF ACTION (WHETHER CONTRACT, TORT, OR OTHERWISE), SHALL BE LIMITED TO THE TOTAL AMOUNT YOU HAVE PAID TO VFXCITED IN THE 12 MONTHS PRECEDING THE CLAIM, PROVIDED YOU NOTIFY VFXCITED OF ANY SUCH CLAIM WITHIN 7 DAYS OF THE INCIDENT GIVING RISE TO THE CLAIM.
Indemnification: You agree to indemnify, defend, and hold harmless VFXcited, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
• Your use or misuse of the Services
• Your violation of these Terms and Conditions
• Your violation of any rights of another party
• Any content you submit or upload to the Services
FORCE MAJEURE
VFXcited shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to:
• Acts of God, natural disasters, pandemics, or epidemics
• War, terrorism, civil unrest, or government actions
• Power outages, internet service provider failures, or network interruptions
• Cyber attacks, hacking attempts, or security breaches not caused by VFXcited's negligence
• Failures of third-party service providers, including hosting, payment processing, or content delivery services
In the event of force majeure, VFXcited will make reasonable efforts to resume normal operations as soon as practicable. If service interruptions due to force majeure exceed 30 consecutive days, you may request a pro-rated refund for the affected period.
DISPUTE RESOLUTION
Informal Resolution: Before pursuing formal legal action, you agree to first attempt to resolve any dispute, claim, or controversy arising from or relating to these Terms or the Services by contacting VFXcited using the information in Section 19. We will work in good faith to resolve the matter informally within 30 days of receiving notice of the dispute.
Complaint Submission: All complaints should be submitted in writing via email or mail (as provided in Section 19), including:
• Your name and account information
• A detailed description of the issue
• Relevant documentation or evidence
• Your proposed resolution
Arbitration (Optional): If informal resolution fails, either party may elect to submit the dispute to binding arbitration under the rules of the Canadian Arbitration Association, conducted in English in Montréal, Québec. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
Litigation: If arbitration is not elected by either party, any unresolved disputes shall be brought exclusively in the courts of Québec, Canada, as specified in Section 2.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
TERM AND TERMINATION
Commencement: This Agreement commences upon the creation of your Individual Account and remains effective until terminated by either party.
Termination by User: You may terminate this Agreement at any time by closing your account and ceasing all use of the Services. Contact us to request account closure.
Termination by VFXcited: VFXcited may terminate this Agreement and your access to the Services immediately upon notice if you:
• Breach any material provision of these Terms
• Engage in account sharing, content distribution, or VPN abuse
• Post, upload, or transmit unacceptable, unlawful, offensive, abusive, or discriminatory content or remarks
• Engage in fraudulent activity or provide false information
• Violate the intellectual property rights of VFXcited or any third party
Effect of Termination: Upon termination:
• Your right to access and use the Services immediately ceases
• You must cease all use of Training Content and delete any downloaded materials
• VFXcited may delete your account data and content after 30 days
• No refunds will be provided for accounts terminated due to violations of these Terms
• Sections relating to intellectual property, warranties, liability limitations, indemnification, and dispute resolution shall survive termination
THIRD-PARTY SERVICES
The Services may utilize third-party service providers for various functions, including but not limited to:
• Payment processing (credit card and other payment method processing)
• Web hosting and content delivery
• Email communications
These third-party providers operate under their own terms of service and privacy policies. While we carefully select our service providers, VFXcited is not responsible for the practices, policies, or actions of third-party services. Your use of third-party services may be subject to their separate terms and conditions.
The Services may contain links to third-party websites or resources. VFXcited is not responsible for the availability, content, or practices of external sites. Links to third-party sites do not constitute an endorsement by VFXcited.
SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent. If such modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICES.
